Operating a Vehicle After Underage Consumption

(OVUAC)
Section 4511.19(B) of the Ohio Revised Code (ORC)


Cause:

  • An individual under 21 years of age is convicted of operating a vehicle with a BAC of .02% or more but less than .08%

Length of Suspension:

  • 60 days - two years ORC 4510.02(A)

Appeal Procedures:

  1. Appeal of conviction must be done through the court that issued the conviction.

  2. An appeal for modified driving privileges must also be made to the court that issued the conviction.

Reinstatement Requirements: Section 4510.038

You must successfully complete a remedial driving instruction course given by an accredited remedial school, if you are 18 years of age or younger you may complete the juvenile driver improvement program (See County List). 

  1. You must file FRA (financial responsibility) Insurance (SR-22 or Bond) if the suspension started before January 1, 2004.  Individuals with a date of offense (OVUAC) on/after January 1, 2004, must provide one of the following insurance types for reinstatement of driving privileges:

    1. A policy of liability insurance coverage for at least $12,500 bodily injury or death of one person, $25,000 bodily injury or death of two or more persons, and $7,500 property damage to others, arising out of any one accident.

    2. A financial responsibility Bond or SR22 equal to the requirement outlined in 1a, effective for not less than one (1) year from the ending date of suspension.

    3. An existing file of financial responsibility with the Ohio Bureau of Motor Vehicles in compliance with another case, which meets the requirements of Chapter 4509 of the Ohio Revised Code.

    NOTE: The remedial driver course must show it was completed after the date of conviction of the OVUAC violation.

  1. BMV Form No. 2836 will be your authorization to retake a complete driver license examination. (See County List) for exam stations.

  2. Additionally, a $30.00 reinstatement fee will be required if the suspension notice was mailed on or after 10/01/97.
