Habitual Use of Alcohol/Drugs

Section 4507.08 (D) O.R.C. Section 4501:1-1-16 (B) & 4501:1-1-18 (C) O.A.C.

Cause: Convicted 3 or more times within the immediately preceding 3 year period of driving under the influence of intoxicating liquor or any combination of driving under the influence of intoxicating liquor or under the influence of a controlled substance.

Length of Suspension: Until Registrar has received a form stating that the person has successfully completed a treatment/rehabilitation program and has maintained sobriety from alcohol or freedom from addiction to a controlled substance for a continuous 6 months from the date the program was completed.

Appeal Procedure: Person has the right to request a hearing by writing to the B.M.V. within 10 days of the date of the suspension notice.

Reinstatement Requirements:

1. Attend a treatment/rehabilitation program given by the Alcohol and Drug Addiction Services Board (See County Lists).

2. Maintain a continuous 6 month period of sobriety or freedom of addiction from date of completion of treatment.

3. A statement from a licensed physician, a licensed psychiatrist, or a certified alcoholism counselor (CCDC 2 or CCDC 3) attesting that the above requirements have been met must be mailed to:

Note: If a person receives a subsequent conviction within 1 year of restoration, of driving under the influence or of a controlled substance, the previous suspension will be re-imposed.
