Collection of $1 Insurance Fee by Motor Vehicle Dealers and Removal of $15
Specialty Plate Fee for a Second Set of Disabled Veteran Specialty Plates |
PURPOSE
To provide information concerning collection of the mandatory $1 Insurance Fee
for the Motor Vehicle Financial Responsibility Verification Program and removal
of the $15 specialty plate fee for the second set of Disabled Veteran (DV)
specialty license plates. This bulletin amends RTBs 087-03, 091-03 and 097-03.
This legislation is effective January 11, 2004. A signed copy of House Bill 002
is attached.
DETAILS
House Bill 002, SECTION 5.08 amended Section 502.1715 (a) and (b),
Transportation Code, as added by House Bill 3588, Acts of the 78th Legislature,
Regular Session, to provide that motor vehicle dealers must collect the $1
Insurance Fee at the time of initial or renewal of registration.
EFFECTIVE JANUARY 11, 2004

The $1 Insurance Fee is to be collected for vehicles at the time of transfer
for any title transactions, new or used, requiring initial registration or
renewal of registration, in addition to other fees imposed for registration of
a motor vehicle.

All title transactions processed on or after January 11, 2004, are subject to
the $1 Insurance Fee, even if the transaction is dated prior to January 11,
2004.

Dealer work processed outside of the Dealer Title Application (DTA) and brought
to the tax office on January 11, 2004, or later will be charged the $1
Insurance fee.

For transactions processed through DTA, RTS will key on the date the
transaction is completed in the dealership, not the date processed in the tax
office.

Programming will be completed and distributed by January 11, 2004, including
transactions processed through DTA.

Registration transactions that include the Dealer Distinguishing Number (i.e.,
P number) will now be charged the $1 Insurance Fee.

To collect the $1 Insurance Fee for Farm Trucks, Farm Truck Tractors, and Tow
Trucks, continue to follow the procedures stated in RTB 087-03.
In addition, House Bill 002, SECTION 5.09 amended Section 504.202 (f),
Transportation Code, as added by House Bill 2971, Acts of the 78th Legislature,
Regular Session, by removing the requirement for qualified disabled veterans to
pay a $15 specialty plate fee for a second set of DV specialty license plates,
in addition to the regular registration fee.

The January 2004 one-part renewal notices for the second set of DV plates will
reflect the $15 specialty plate fee. Any checks received after January 11,
2004, will be returned by the department.

The February 2004 and subsequent one-part specialty plate renewal notices will
not reflect the $15 plate fee for a second set of DV license plates.
